Request for Order re: Child Custody / Visitation / Support:

(may include spousal support and/or division of assets and debts)


Once papers are filed (ie, divorce or a  parentage), you can ask for a court date so a judge can make a decision about your financial or family situation. You can request an order about many issues, like child or spousal support, or custody and visitation.  



Petition to Establish Parental Relationship/Paternity:


In California, only legal parents can get custody and visitation  (parenting time) orders about their child. Legal parents also have a  responsibility to support their child financially.  


In part, this process calls for a legal decision whether someone is a child's  legal parent that will allow for custody, visitation and support.


Ex-Parte Applications for Temporary Custody and Visitation Orders:


The purpose of these orders is to address matters that cannot be heard on the court's regular calendar.  The process is used to request orders to help prevent immediate danger or harm to a party or the children. 

Domestic Violence Restraining Orders (DVRO):

  

A DVRO is against someone you've dated or had an intimate relationship with, including a spouse or domestic partner. It can also be against a relative if they are your child, parent, sibling or grandparent. This includes in-laws.


A DVRO can be granted against someone who has abused you or your children. Abuse can be emotional or physical.  

Guardianship:


A guardianship is when an adult, who is not a child's parent, is legally  responsible for the child's care . . . It may also mean someone manages the child's money or  property.  

  

Adoption:


In an adoption, the court establishes a legal parent-child relationship between a child and a parent who is not the child's biological or birth parent.
